Iraq

What should Iraq do to win this case ?⁉

To win its case under international law, Iraq must abandon unilateral deposits like M.Z.N.172.2026.LOS and immediately initiate formal, binding dispute settlement procedures under Article 287 of the 1982 United Nations Convention on the Law of the Sea (UNCLOS). Before the International Tribunal for the Law of the Sea (ITLOS) or the International Court of Justice (ICJ), Baghdad must invoke the equitable principle of "proportionality" and the legal doctrine of

"geographic disadvantage/landlocked-like coastlines".

Because strict equidistance (median lines) severely cuts off Iraq's access to international waters beyond Point 162, Iraq must legally prove that strict application of median lines creates an unconscionable inequity that deprives a sovereign nation of viable maritime corridor access.

By combining this UNCLOS litigation strategy with a domestic political resolution—such as legally re-ratifying a clear, bilateral navigational corridor agreement in Khor Abdullah—Iraq can bypass the GCC's collective diplomatic bloc and secure guaranteed, recognized access to the Gulf.
